Welcome to the Flash Coffee application.

By registering and / or using the Flash Coffee application (the “App”), a product developed by Digital Services SG Four Pte Ltd and operated by Flash Coffee Pte Ltd, you agree to accept and be bound by these terms and conditions and they will automatically apply to you – you should make sure therefore that you read them carefully before using the app. If you do not agree to these terms and conditions, please do not use the App, register an account or participate in our program.

Flash Coffee is committed to ensuring that the App is as useful and efficient as possible. For that reason we reserve the rights to make changes to the App at any time. The App can be downloaded on Android & iOS –  the requirements for both systems (and for any additional systems we decide to extend the availability of the App to) may change, and you’ll need to download the updates if you want to keep using the App. You may use the App and the content made available in it for your personal purpose only and strictly not for revenue generation, commercial enterprise or other purposes for which it is not designed or intended.

Flash Coffee does not promise that it will always update the App so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the App when offered to you. We may also wish to stop providing the App, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the App, and (if needed) delete it from your device.

You’re not allowed to copy, or modify the App, any part of the App, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the App, and you also shouldn’t try to translate the App into other languages, or make derivative versions. The App itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Flash Coffee Pte. Ltd or its third party service providers.  You must not republish, sell, rent or sub-license, reproduce, duplicate or copy any material from the App, redistribute content from Flash Coffee (unless content is specifically made for redistribution), obtain intellectual property rights, or attempt to obtain, any title to any such intellectual property rights, or commercially exploit or disseminate any such.

To use our services you are required to register an account (the “account”) with the App. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to refuse to provide you access to our services or to allow you to open an Account for any reason. Furthemore, we reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. Please notify Flash Coffee Support immediately if there is an unauthorised use of your account. You are fully responsible for all activities that occur under your account even if such activities or uses were not committed by you. Flash Coffee will not be liable for any loss or damage arising from unauthorised use of your password or your failure to comply with this paragraph.

Your privacy is very important to Flash Coffee. We collect, use, disclose and/or process only such personal information or personal data as reasonably required to enable us to provide our service. By using the App or providing information or data on the App, you consent and authorize the collection, use, disclosure and/or processing by us of any information and data related or derived from your use of the App and any information or data that you provide to us. You have the right to access your data and correct or update the data by writing an email directly to us at [email protected].

It’s your responsibility to keep your phone and access to the App secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/ viruses/ malicious programs, compromise your phone’s security features and it could mean that the App won’t work properly or at all.

The App does use third party services that declare their own Terms and Conditions.

You should be aware that there are certain things that Flash Coffee will not take responsibility for. Certain functions of the App will require the App to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Flash Coffee cannot take responsibility for the App not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the App, or other third party charges. In using the App, you’re accepting responsibility for any such charges, including roaming data charges if you use the App outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the App, please be aware that we assume that you have received permission from the bill payer for using the App.

Along the same lines, Flash Test cannot always take responsibility for the way you use the App i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Flash Coffee cannot accept responsibility.

With respect to Flash Coffee’s responsibility for your use of the App, when you’re using the App, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make the App available to you. We specifically disclaim compatibility between the App and any software or hardware. We do not warrant that the App will be compatible or interoperable with your mobile device or any other hardware, software, equipment or device installed on or used in connection with your mobile device or that we will update the App so that it is relevant to you and/or works with your mobile device. Any compatibility and interoperability problems may cause the performance of your mobile device to diminish or fail completely, and may result in permanent damage to your mobile device, loss of the data and/or corruption of software and files contained in your mobile device. You acknowledge and agree that we shall have no liability to you for any losses suffered resulting from or arising in connection with compatibility or interoperability problems.

If your order made through the App is cancelled, Flash Coffee will refund your payment in the form of Flash Coffee Points which can be used for your next purchase of our products through the App. Flash Coffee does not monitor the cancellation and refund process for offline payment.

To the maximum extent permitted by applicable law, we exclude all representations, warranties, conditions, and liability for any injury, loss, claim, damage, whether actual, incidental, special, indirect, exemplary, punitive or consequential,  relating to our App and its use (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

 

  • limit or exclude our or your liability for death or personal injury resulting from negligence;
  • limit or exclude our or your liability for fraud, fraudulent misrepresentation or misrepresentation as to a fundamental matter;
  • limit any of our or your liabilities in any way that is not permitted under applicable law; or
  • exclude any of our or your liabilities that may not be excluded under applicable law.

 

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

To the extent that the App and the information and services on the App are provided free of charge, we will not be liable for any loss or damage of any nature.

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.

This Agreement shall be governed by Singapore law, without regard to the choice or conflicts of law provisions of any jurisdiction, and any disputes, actions, claims or causes of action arising out of or in connection with the Terms of Use or the Service shall be referred to the Singapore International Arbitration Centre (“SIAC”), in accordance with the Rules of the SIAC as modified or amended from time to time (the “Rules”) by a sole arbitrator appointed by the mutual agreement of the parties (the “Arbitrator”). If parties are unable to agree on an arbitrator, the Arbitrator shall be appointed by the President of SIAC in accordance with the Rules. The seat and venue of the arbitration shall be Singapore, in the English language and the fees of the Arbitrator shall be borne equally by the parties, provided that the Arbitrator may require that such fees be borne in such other manner as the Arbitrator determines is required in order for this arbitration clause to be enforceable under applicable law.

If parties are unable to agree on an arbitrator, the Arbitrator shall be appointed by the President of SIAC in accordance with the Rules. The seat and venue of the arbitration shall be Singapore, in the English language and the fees of the Arbitrator shall be borne equally by the parties, provided that the Arbitrator may require that such fees be borne in such other manner as the Arbitrator determines is required in order for this arbitration clause to be enforceable under applicable law.

By registering and/or using the Flash Coffee application (the “App”), a product developed by Digital Services SG Four Pte Ltd and operated by Flash Coffee TW Co., Ltd, you agree to accept and be bound by these terms and conditions and they will automatically apply to you – you should make sure therefore that you read them carefully before using the app. If you do not agree to these terms and conditions, please do not use the App, register an account or participate in our program.

  2. Flash Coffee is committed to ensuring that the App is as useful and efficient as possible. For that reason we reserve the rights to make changes to the App at any time.   3. Flash Coffee does not promise that it will always update the App so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, if you wish to continue using the App, you will have to accept updates to the App when offered to you. We may also stop providing the App, and may terminate use of it at any time without giving notice of termination to you.   4. You’re not allowed to copy, or modify the App, any part of the App, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the App, and you also shouldn’t try to translate the App into other languages, or make derivative versions. The App itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to Flash Coffee TW Co., Ltd or its third party service providers. You must not republish, sell, rent or sub-license, reproduce, duplicate or copy any material from the App, redistribute content from Flash Coffee (unless content is specifically made for redistribution), obtain intellectual property rights, or attempt to obtain, any title to any such intellectual property rights, or commercially exploit or disseminate any such.您不得以任何方式複製或修改本應用程式、本應用程式之任何部分或我們的商標。您不得試圖擷取本應用程 式之原始碼,您也不應嘗試將本應用程式翻譯為其他語言或製作任何衍伸版本。本應用程式以及所有相關之 商標、著作權、資料庫權利以及其他智慧財產權,應屬於閃電咖啡股份有限公司或其第三方服務供應商。您 不得再次發行、販售、出租或再授權、重製、拷貝或複製任何本應用程式之素材,亦不得再傳佈任何來自 Flash coffee 的內容(除非該內容是特別為了再次傳佈而製作),獲取或試圖獲取智慧財產權或該智慧財產權之所 有權、或商業性使用或散佈該智慧財產權。

To use our services you are required to register an account (the “account”) with the App. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to refuse to provide you access to our services or to allow you to open an Account for any reason. Furthermore, we reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. Please notify Flash Coffee Support immediately if there is any unauthorised use of your account. You are fully responsible for all activities that occur under your account even if such activities or uses were not committed by you. By using the App or providing information or data on the App, you consent and authorize the collection, use, disclosure and/or processing by us of any information and data related to or derived from your use of the App and any information or data that you provide to us.   7. It’s your responsibility to keep your phone and access to the App secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device.   2. You should be aware that there are certain things that Flash Coffee will not take responsibility for. Certain functions of the App will require the App to have an active internet connection. In using the App, you’re accepting responsibility for any such charges, including roaming data charges if you use the App outside of your home territory (i.e. region or country) without turning off data roaming. We specifically disclaim compatibility between the App and any software or hardware. We do not warrant that the App will be compatible or interoperable with your mobile device or any other hardware, software, equipment or device installed on or used in connection with your mobile device or that we will update the App so that it is relevant to you and/or works with your mobile device. Any compatibility and interoperability problems may cause the performance of your mobile device to diminish or fail completely, and may result in permanent damage to your mobile device, loss of the data and/or corruption of software and files contained in your mobile device.   1. If your order made through the App was cancelled, Flash Coffee will refund your payment through the same payment channel the order has been placed through. The refund duration usually takes 3 to 5 working days, depending on each payment channel’s SLA. If you paid by credit card, it may take up to 30 days to process, depending on your card provider. Nothing in this disclaimer will:
    • limit or exclude our or your liability for death or personal injury resulting from negligence;
    • limit or exclude our or your liability for fraud, fraudulent misrepresentation or misrepresentation as to a fundamental matter;
    • limit any of our or your liabilities in any way that is not permitted under applicable law; or
    • exclude any of our or your liabilities that may not be excluded under applicable law.

In using the App, you’re accepting responsibility for any such charges, including roaming data charges if you use the App outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the App, please be aware that we assume that you have received permission from the bill payer for using the App.

Along the same lines, Flash Coffee cannot always take responsibility for the way you use the App, i.e. you need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Flash Coffee cannot accept responsibility.

With respect to Flash Coffee’s responsibility for your use of the App, when you’re using the App, it is important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make the App available to you. We specifically disclaim compatibility between the App and any software or hardware. We do not warrant that the App will be compatible or interoperable with your mobile device or any other hardware, software, equipment or device installed on or used in connection with your mobile device or that we will update the App so that it is relevant to you and/or works with your mobile device. Any compatibility and interoperability problems may cause the performance of your mobile device to diminish or fail completely, and may result in permanent damage to your mobile device, loss of the data and/or corruption of software and files contained in your mobile device. You acknowledge and agree that we shall have no liability to you for any losses suffered resulting from or arising in connection with compatibility or interoperability problems.

When making payment for an order, you are required to select the payment method made available to you on the App, which may be by credit card, debit card, e-payment or cash-on-pick-up (if available). Subject to the other provisions in our Terms and Conditions, any payment pursuant to such selection is non-refundable and irrevocable.

For the avoidance of doubt, Flash Coffee has the sole and absolute discretion to include or remove cash-on-pick-up as a payment method on the App in general or for selected customers only, from time to time. If cash-on-pick-up payment option is selected for your order, such order may not exceed an aggregate value of HK$250.

You have the right to cancel your order only if Flash Coffee has not yet accepted your order. Should you still decide to cancel your order after it has been accepted by Flash Coffee, you understand that you shall forfeit your cancelled order. If cash-on-pick-up payment option is selected, and you fail to pick up and pay for your order for [2] or more times, you understand that cash-on-pick-up may be removed from your list of available payment methods for your future orders or your account may be suspended.

If your order made through the App was cancelled by Flash Coffee or by you in accordance with the provisions of our Terms and Conditions, Flash Coffee will refund any payment made through the same payment channel the order has been placed through. The refund duration usually takes 3 to 5 working days, depending on each payment channel’s service agreement . If you paid by credit card, it may take up to 30 days to process, depending on your card provider. Flash Coffee does not monitor the cancellation and refund process for offline payment.

To the maximum extent permitted by applicable law, we exclude all representations, warranties, conditions, and liability for any injury, loss, claim, damage, whether actual, incidental, special, indirect, exemplary, punitive or consequential, relating to our App and its use (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

  • limit or exclude our or your liability for death or personal injury resulting from negligence;
  • limit or exclude our or your liability for fraud, fraudulent misrepresentation or misrepresentation as to a fundamental matter;
  • limit any of our or your liabilities in any way that is not permitted under applicable law; or
  • exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in these Terms and Conditions (a) are subject to the preceding paragraph; and (b) govern all liabilities arising in relation to the App , including (without limitation) liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

To the extent that the App and the information and services on the App are provided free of charge, we will not be liable for any loss or damage of any nature.

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.

These Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“HKSAR”) You irrevocably consent to the non-exclusive jurisdiction of the courts of HKSAR for purposes of any legal action arising out of or related to the use of the App or these Terms and Conditions.

Digital Services SG Four Pte Ltd가 개발하고 플래시커피코리아 유한책임회사(“Flash Coffee”)가 운영하는 제품인 Flash Coffee 어플리케이션(“App”)의 본 이용약관에 동의함으로써, 귀하는 본 약관을 수락하고 준수하기로 동의하는 것입니다. 따라서 App을 사용하기 전에 본 약관의 내용을 반드시 주의 깊게 읽으시기 바랍니다. 만일 본 약관에 동의하지 않으시면, App을 사용하거나, 계정을 등록하거나 혹은 저희의 프로그램에 참여하지 마십시오.

Flash Coffee는 App의 유용성과 효율성을 최대한 보장할 것을 약속합니다. 그런 이유에서 저희는 App을 수시로 변경할 수 있는 권리를 보유합니다. 그러나 변경사항이 발생할 경우에는 사전에 귀하에게 통지할 것입니다. 다만, 버그/에러 수정, 긴급 업데이트, 중대하지 않다고 판단되는 변경, 서버 결함 또는 기타 긴급한 상황(중요한 보안 문제를 해결하기 위해 필요한 변경 등)의 경우에는 예외적으로 변경 후 사후적으로 통지가 이루어질 수도 있습니다. App은 안드로이드와 iOS에서 다운로드 할 수 있고, 두 운영체제(그리고 그 밖에 저희가 App을 제공하기로 한 추가적인 시스템)의 요건은 변동될 수 있으며, 계속해서 App을 사용하기를 원하시는 경우 업데이트를 다운로드 하셔야 합니다. 귀하는 App과 App 상에서 제공되는 콘텐츠를 오직 사적인 용도로만 사용할 수 있으며, 수익 창출, 영리 사업 또는 기타 계획 혹은 의도되지 않은 용도로 App을 사용하는 행위는 엄격히 금지됩니다.

Flash Coffee는 App이 귀하에게 적절하도록, 그리고/또는 App이 귀하의 기기에 설치된 안드로이드 또는 iOS에서 구동하도록 항상 App을 업데이트할 것임을 약속하지 않습니다. 그러나 귀하는 귀하에게 업데이트가 제공될 경우 항상 업데이트를 수락하겠다고 약속합니다. 저희는 App의 제공을 중단하고자 할 수 있으며, 귀하에게 종료를 통지한 후 언제든지 App의 사용을 종료할 수 있습니다. 저희가 달리 안내하지 않는 한, 종료 즉시 (a) 본 약관에 따라 귀하에게 부여된 권리와 사용권은 종료되며, (b) 귀하는 App의 사용을 중단하고 (필요시) 귀하의 기기에게 App을 삭제해야 합니다.

귀하는 App, App의 일부 또는 저희의 상표를 어떤 식으로도 복제 또는 수정해서는 안 됩니다. 귀하는 App의 소스코드를 추출하고자 시도해서는 안 되며, App을 다른 언어로 번역하거나 파생 버전을 만들고자 시도해서도 안 됩니다. App 자체, 그리고 App과 관련된 모든 상표, 저작권, 데이터베이스권 및 기타 지식재산권은 여전히 Flash Coffee 또는 그의 제3자 서비스 제공자에게 귀속됩니다. 귀하는 App에서 어떠한 자료도 리퍼블리싱, 판매, 대여 또는 재라이선싱, 재생산, 복사 또는 복제할 수 없고, Flash Coffee에서 나온 콘텐츠를 재배포(컨텐츠가 특별히 재배포를 목적으로 만들어진 경우는 제외)하거나, 지식재산권을 획득하거나, 그러한 지식재산권에 대한 소유권을 획득하려고 시도하거나, 또는 그러한 것들을 상업적으로 이용 또는 전파할 수 없습니다.

저희의 서비스를 사용하기 위해서, 귀하는 App에 계정을 등록해야 합니다. 귀하는 비밀번호를 비밀로 유지하기로 동의하며, 귀하의 계정과 비밀번호의 사용 일체에 대한 책임은 귀하에게 있습니다. 관련 법률 또는 규정을 전제로, 저희는 여하한 이유로 귀하에게 저희의 서비스에 대한 접근권을 제공하거나 귀하가 계정을 개설하는 것을 거부할 수 있는 권리를 보유합니다. 나아가, 저희는 자율적인 판단에 따라 귀하의 사용자명이 부적절하거나, 외설적이거나 그 밖에 반대할 만한 이유가 있다고 판단할 경우, 귀하가 선택한 사용자명을 삭제, 회수 또는 변경할 수 있는 권리가 있습니다. 만일 귀하의 계정에 대한 무단 사용이 발생할 경우, 즉시 Flash Coffee 지원팀에게 알려주시기 바랍니다. 귀하는 귀하의 계정에서 발생한 일체의 행위에 대하여, 비록 그러한 행위 또는 사용이 귀하에 의한 것이 아니라 하더라도 전적인 책임을 부담합니다. Flash Coffee는 귀하의 비밀번호에 대한 무단 사용 또는 귀하가 본 항을 준수하지 않음으로써 발생하는 어떠한 손실이나 손해도 책임지지 않습니다.

귀하의 개인정보 보호는 Flash Coffee에게 매우 중요합니다. 저희는 서비스를 제공하기 위해 합리적으로 필요한 개인정보 또는 개인 데이터만을 수집, 사용, 공개 및/또는 처리합니다. 귀하는 개인정보 처리에 동의함으로써, 귀하의 App 사용과 관련되거나 그러한 사용에서 유래한 정보 및 데이터, 그리고 귀하가 저희의 개인정보처리방침에 따라 저희에게 제공한 정보 또는 데이터를 수집, 사용, 공개 및/또는 처리함에 동의하고 이를 승인하는 것입니다. 귀하는 귀하의 데이터에 접근하고 [email protected] 에 직접 이메일을 보내어 데이터를 수정 또는 업데이트할 수 있는 권리가 있습니다.

귀하의 휴대폰과 App에 대한 접근성의 보안을 유지하는 것은 귀하의 책임입니다. 따라서 저희는 귀하의 기기의 운영체제가 부과한 소프트웨어의 제한과 제약을 제거하는 과정인 탈옥(jailbreak)이나 루팅(rooting)을 하지 않는 것을 권장합니다. 이러한 행위는 귀하의 휴대폰을 악성코드/바이러스/악성 프로그램에 취약하게 만들 수 있고, 귀하의 휴대폰에 있는 보안 기능을 약화시킬 수 있으며, App이 정상적으로 작동하지 않거나 전혀 작동하지 않게 할 수도 있습니다.

App은 독자적인 이용약관을 가진 제3자 서비스를 사용합니다. App에서 사용된 제3자 서비스 제공자의 이용약관에 대한 링크는 아래와 같습니다.

귀하는 Flash Coffee가 책임지지 않는 특정 사항이 있다는 사실을 인지해야 합니다. App의 일부 기능을 사용하기 위해서는 App이 활성화된 인터넷에 연결되어 있어야 합니다. 연결은 와이파이일 수도 있고 귀하의 이동통신 사업자가 제공한 네트워크일 수도 있으나, Flash Coffee는 만일 귀하가 와이파이에 접속해 있지 않고 남은 데이터 용량이 없을 경우, App이 제대로 작동하지 않더라도 책임질 수 없습니다.

만약 App을 와이파이가 없는 지역에서 사용할 경우, 귀하가 이동통신사업자와 맺은 계약의 조건이 여전히 적용된다는 사실을 기억하시기 바랍니다. 그 결과, 귀하에게는 귀하가 App을 사용하면서 인터넷을 사용한 시간 동안의 데이터 비용이 귀하의 이동통신 사업자로부터 부과되거나 그 밖의 제3자 요금이 부과될 수 있습니다. App을 사용하는 과정에서 귀하는 데이터 로밍을 끄지 않고 App을 기본 영역(즉 지역 또는 국가) 밖에서 사용할 경우의 로밍 데이터 요금을 포함하여 그러한 요금에 대한 책임을 수락합니다. 만일 귀하가 App을 사용하고 있는 기기의 요금 납부자가 아닐 경우, 저희는 App 사용에 대하여 귀하가 요금 납부자로부터 허락을 얻었다고 가정한다는 사실을 인지하시기 바랍니다.

같은 맥락에서, Flash Coffee는 귀하가 App을 사용하는 방식에 대하여 항상 책임을 질 수는 없습니다. 즉 귀하는 귀하의 기기가 충전되어 있는지 확인해야 하며, 만일 배터리가 닳아 App을 켜고 서비스를 사용할 수 없다면, Flash Coffee는 이에 대한 책임을 질 수 없습니다.

귀하의 App 사용에 대한 Flash Coffee의 책임과 관련하여, 귀하가 App을 사용하는 경우, 저희는 항상 App이 업데이트되어 있고 정확한 상태에 있도록 노력하지만, 저희가 귀하에게 App을 제공하기 위해서는 제3자가 제공하는 정보에 의존한다는 사실을 반드시 염두에 두시기 바랍니다. 저희는 구체적으로 App과 여하한 소프트웨어 또는 하드웨어 간의 호환성에 대한 책임을 부인합니다. 저희는 App이 귀하의 모바일 기기 또는 귀하의 모바일 기기에 설치되거나 동 기기와 연계하여 사용되는 기타 하드웨어, 소프트웨어, 장비 또는 기기와 호환되거나 상호 사용이 가능하다고 보증하지 않으며, App이 귀하에게 적절하고/하거나 귀하의 모바일 기기에서 구동하도록 App을 업데이트할 것이라고 보증하지 않습니다. 호환성 또는 상호 운용성 문제로 인해 귀하의 모바일 기기 성능이 저하되거나 동 기기가 전혀 성능을 발휘하지 못할 수 있으며, 귀하의 모바일 기기의 영구적인 손상, 귀하의 모바일 기기에 저장되어 있는 데이터의 손실 및/또는 소프트웨어 및 파일의 변질이 발생할 수 있습니다. 귀하는 저희가 호환성 또는 상호 운용성 문제의 결과로 또는 그와 연관되어 발생한 손해에 대하여 귀하에게 어떠한 책임도 지지 않는다는 사실을 인정하고 이에 동의합니다.

주문 결제 시, 귀하는 App에서 사용할 수 있는 결제수단을 선택해야 하며, 이러한 결제수단은 신용카드, 직불카드, 전자 지급결제 또는 수령 시 현금결제(가능할 경우)가 될 수 있습니다. 본 이용약관의 다른 조항과 관련 법률 또는 규정을 전제로, 그러한 선택에 따른 결제는 환불되지 않으며 취소가 불가합니다.

의심의 여지를 피하기 위하여 부연하면, Flash Coffee는 일반적으로 또는 선택된 고객에 한하여 수령 시 현금결제를 수시로 결제수단에 포함시키거나 제외할 수 있는 절대적인 단독 재량을 갖고 있습니다. 만약 귀하의 주문에서 수령 시 현금결제 옵션이 선택된 경우, 해당 주문은 합계 9,000원을 초과할 수 없습니다.

귀하는 Flash Coffee가 주문을 승인하기 전까지만 주문을 취소할 수 있는 권리가 있습니다. Flash Coffee에서 주문이 승인된 이후에 귀하가 주문을 취소하고자 하는 경우, 귀하는 취소되는 주문 건을 상실한다는 사실을 인지합니다. 만일 귀하가 수령 시 현금결제 옵션을 선택하였으나 [2]회 이상 수령 및 주문에 대한 결제를 하지 않을 경우, 수령 시 현금결제 옵션이 향후 귀하의 이용 가능 결제수단에서 제외되거나 귀하의 계정이 사용 중단될 수 있다는 사실을 인지합니다. 이 항은 관련 법률 또는 규정이 허용하는 범위에서만 적용됩니다.

만약 App을 통한 귀하의 주문이 저희의 이용약관 조항에 따라 Flash Coffee 또는 귀하에 의하여 취소된 경우, Flash Coffee는 해당 주문이 이루어진 동일한 결제 방법을 통해 지불금액을 환불합니다. 환불에는 각 결제 방법의 서비스레벨계약(SLA)에 따라 일반적으로 3~5영업일이 소요됩니다. 만약 신용카드로 결제하신 경우, 귀하의 카드사에 따라 처리되는 데 최대 30일이 소요될 수 있습니다. Flash Coffee는 현장 결제의 취소 및 환불 절차는 모니터링 하지 않습니다. 이 항은 관련 법률 또는 규정이 허용하는 범위에서만 적용됩니다.

관련 법률이 허용하는 최대 한도 내에서, 저희는 저희의 App 및 그 사용과 관련하여, 어떠한 진술, 보증, 조건 및 실제, 부수적, 특별, 간접, 징벌적 또는 결과적 피해, 손실, 청구 또는 손해에 대한 책임(품질 만족, 합목적성 및/또는 합리적 주의와 기술의 사용과 관련하여 법률이 시사하는 제한, 보증을 포함하되 이에 한정되지 아니함)도 배제합니다. 이 면책조항의 어떠한 내용도 다음 중 어느 하나에 해당하지 않습니다. – 부주의로 인한 사망 또는 신체적 상해에 대하여 저희 또는 귀하의 책임을 제한하거나 배제 – 핵심적인 사항에 대한 사기, 악의적 부실표시 또는 허위진술에 대하여 저희 또는 귀하의 책임을 제한하거나 배제 – 관련 법률이 허용하지 않는 저희 또는 귀하의 책임을 어떤 식으로든 제한 – 관련 법률에 따라 배제될 수 없는 저희 또는 귀하의 책임을 배제.

본 조 및 이 면책조항의 다른 부분에 명시된 책임의 제한 및 배제는 (a) 전항을 전제로 하며, (b) 계약, 불법행위(과실 등) 및 법적 의무 위반을 포함하여 본 면책조항에 따라 또는 본 면책조항의 대상과 관련하여 발생하는 모든 책임을 규율합니다.

App과 App 상의 정보 및 서비스가 무료로 제공되는 범위에서, 저희는 어떠한 성격의 손실 또는 손해에 대해서도 책임지지 않습니다.

저희는 본 이용약관을 수시로 업데이트 할 수 있습니다. 따라서, 사용자는 이 페이지를 정기적으로 검토하고 변경사항을 확인할 것을 권고합니다. 저희는 변경사항이 있을 경우, 이 페이지에 새로운 이용약관을 게재하고 중대하지 않은 변경의 경우는 7일 전의, 그리고 중대한 변경이나 귀하에게 불리한 변경의 경우 30일 전의 사전 고지를 통해 귀하에게 변경사항을 통지합니다.

본 이용약관은 싱가포르 법률의 적용을 받습니다. 귀하는 App의 사용 또는 본 이용약관으로 인해 발생하거나 그와 관련된 법적 소송과 관련하여 귀하의 거주 국가 법원의 관할권에 취소 불가능하게 동의합니다.

Digital Services SG Four Pte Ltdが開発し、Flash Coffee JP LLC(以下「フラッシュコーヒー」といいます)が運営するフラッシュコーヒーのアプリケーション(以下「本アプリ」といいます)に登録し、使用することにより、お客様は本規約に同意したとみなされ、自動的に適用されることになります。本規約にご同意いただけない場合は、本アプリのご利用、アカウントの登録、プログラムへの参加をご遠慮ください。

フラッシュコーヒーは、本アプリが可能な限り便利で効率的なものとなるように努めています。そのため、当社はいつでも本アプリに変更を加える権利を有します。本アプリは、AndroidおよびiOSでダウンロードすることができますが、両システム(および当社が本アプリの提供範囲を拡大することを決定した追加のシステム)の要件が変更される可能性がありますので、本アプリを継続して使用したい場合は、アップデートをダウンロードする必要があります。お客様は、本アプリおよび本アプリで利用可能なコンテンツを、お客様の個人的な目的でのみ使用することができ、収益創出、商業的事業、または本アプリが設計または意図されていないその他の目的のために使用することはできません。

フラッシュコーヒーは、本アプリがお客様にとって適切であり、かつ、お客様のデバイスにインストールされているAndroidおよびiOSのバージョンで動作するように、本アプリを常にアップデートすることを約束しません。しかし、お客様は、本アプリのアップデートが提供された場合、常にこれを受け入れることを約束します。また、当社は、本アプリの提供の中止を希望する場合があり、お客様に中止の通知をすることなく、いつでも本アプリの使用を中止することができます。当社が別段の指示をしない限り、終了時には、(a)本規約でお客様に付与された権利およびライセンスは終了し、(b)お客様は本アプリの使用を中止し、(必要に応じて)お客様のデバイスから本アプリを削除しなければなりません。

お客様は、本アプリ、本アプリの一部、または当社の商標をいかなる方法でもコピー、変更することはできません。また、本アプリのソースコードを抽出しようとしたり、本アプリを他の言語に翻訳したり、派生バージョンを作成したりすることもできないものとします。本アプリ自体、および本アプリに関連するすべての商標、著作権、データベース権、その他の知的財産権は、依然としてFlash Coffeeまたはその第三者のサービス提供者に帰属します。  お客様は、本アプリの再発行、販売、貸与、サブライセンス、複製、複写、フラッシュコーヒーのコンテンツの再配布(コンテンツが特に再配布用に作られている場合を除く)、知的財産権の取得、または取得の試み、商業的な利用や普及を行ってはなりません。

当社のサービスを利用するためには、お客様は本アプリにアカウント(以下「本アカウント」といいます)を登録する必要があります。お客様は、パスワードを厳守することに同意し、お客様のアカウントおよびパスワードのすべての使用に対して責任を負います。当社は、理由の如何を問わず、お客様が当社のサービスにアクセスすることを拒否する権利、またはお客様がアカウントを開設することを許可する権利を留保します。さらに、当社は、お客様が選択したユーザー名が不適切、わいせつ、またはその他の好ましくないものであると当社が独自の裁量で判断した場合、当該ユーザー名を削除、再生、または変更する権利を有します。お客様のアカウントの不正使用があった場合は、直ちにフラッシュコーヒーサポートにご連絡ください。お客様のアカウントで発生したすべての活動は、たとえそのような活動や使用がお客様によって行われたものでなくても、お客様がすべての責任を負うものとします。フラッシュコーヒーは、お客様のパスワードの不正使用や、お客様が本項に従わなかったことから生じるいかなる損失や損害に対しても責任を負いません。

お客様のプライバシーは、フラッシュコーヒーにとって非常に重要です。当社は、当社のサービスを提供するために合理的に必要とされる個人情報または個人データのみを収集、使用、開示および/または処理します。本アプリを使用すること、または本アプリ上で情報またはデータを提供することにより、お客様は、お客様の本アプリの使用に関連または由来する情報およびデータ、ならびにお客様が当社に提供する情報およびデータを、当社が当社のプライバシーポリシーに従って収集、使用、開示および/または処理することに同意し、承認したことになります。お客様は、当社[email protected]に直接電子メールを書くことにより、ご自身のデータにアクセスし、データを修正または更新する権利を有します。

お使いの携帯電話と本アプリへのアクセスを安全に保つことは、お客様の責任です。したがって、お客様の携帯電話を脱獄またはルート化しないことをお勧めします。脱獄またはルート化とは、お客様の携帯電話の正式なオペレーティングシステムによって課せられたソフトウェアの制限および制約を取り除くプロセスです。これにより、お客様の携帯電話がマルウェア/ウィルス/悪意のあるプログラムに対して脆弱になったり、携帯電話のセキュリティ機能が損なわれたり、本アプリが正しく動作しなくなったりする可能性があります。

本アプリでは、独自の利用規約を定めた第三者のサービスを利用しています。

本アプリが利用する第三者のサービスプロバイダーの利用規約へのリンクは以下のとおりです。

お客様は、フラッシュコーヒーが責任を負わないものがあることをご承知おきください。本アプリの一部の機能は、本アプリがインターネットに接続されていることを必要とします。インターネット接続は、Wi-Fiまたはお客様の携帯電話会社から提供されますが、お客様がWi-Fiにアクセスできず、データ使用量が残っていない場合、本アプリが完全に動作しないことについて、フラッシュコーヒーは責任を負いません。

お客様がWi-Fiのあるエリア以外で本アプリを使用する場合、お客様の携帯電話会社との契約条件が引き続き適用されることを覚えておいてください。その結果、お客様は、本アプリにアクセスしている間の接続期間中のデータ料金、またはその他の第三者の料金を携帯電話会社から請求される可能性があります。本アプリを使用することにより、お客様は、データローミングをオフにせずにお客様のホームテリトリー(地域または国)外で本アプリを使用した場合のローミングデータ料金を含め、かかる料金に対する責任を受け入れることになります。お客様が本アプリを使用している機器の料金支払者でない場合、本アプリの使用について料金支払者の許可を得ているものとみなしますので、ご了承ください。

また、お客様が本アプリを利用する際には、お客様の端末が充電されていることを確認する必要がありますが、電池切れで本サービスを利用できない場合、当社は責任を負いません。

お客様による本アプリの使用に関するフラッシュコーヒーの責任について、お客様が本アプリを使用する際には、当社は本アプリが常に更新され正しいものであるように努めていますが、当社がお客様に本アプリを提供するために、当社への情報提供を第三者に依存していることを念頭に置くことが重要です。当社は、本アプリとあらゆるソフトウェアまたはハードウェアとの間の互換性を明確に否認します。当社は、本アプリが、お客様のモバイル機器、またはお客様のモバイル機器にインストールされたもしくはモバイル機器に関連して使用されるその他のハードウェア、ソフトウェア、機器もしくはデバイスと互換性または相互運用性があること、または本アプリがお客様に関連し、かつ/またはお客様のモバイル機器で動作するように当社が本アプリを更新することを保証しません。互換性および相互運用性の問題は、お客様のモバイル機器の性能低下または完全な故障の原因となり、また、お客様のモバイル機器への恒久的な損害、データの喪失、および/またはお客様のモバイル機器に含まれるソフトウェアおよびファイルの破損の原因となる場合があります。お客様は、互換性または相互運用性の問題に起因して、または関連して生じた損失について、当社がお客様に対して一切の責任を負わないことを認め、同意するものとします。

ご注文のお支払いの際には、お客様は、本アプリ上で利用可能なお支払い方法を選択する必要があります。 クレジットカード、デビットカード、電子決済、またはキャッシュオンピッキング(可能な場合)です。当社のご利用規約の他の条項に従い、かかる選択に基づく支払いは、返金不可かつ取消不可となります。

疑義を避けるために、フラッシュコーヒーは、本アプリにおける支払い方法として、キャッシュオンピックアップを一般的に、または特定のお客様のみを対象として、随時追加または削除する単独かつ絶対的な裁量権を有しています。お客様のご注文に代金引換が選択された場合、当該ご注文は合計金額が800円を超えることはできません。 800

お客様は、フラッシュ・コーヒーがお客様の注文をまだ受け付けていない場合に限り、注文をキャンセルする権利を有します。フラッシュコーヒーが注文を受け付けた後にお客様が注文を取り消す場合、お客様は取り消された注文を没収されることを理解するものとします。代金引換払いを選択した場合、お客様が2回以上注文の受け取りと支払いを行わなかった場合、お客様は現金を受け取ることができません。     キャッシュオンピックアップが選択されている場合、お客様が2回以上注文の受け取りと支払いを行わなかった場合、今後の注文で利用可能な支払い方法のリストからキャッシュオンピックアップが削除されるか、お客様のアカウントが停止される可能性があることをご了承ください。

本アプリを通じて行われたお客様の注文が、当社またはお客様によって当社の利用規約の規定に従って取り消された場合、フラッシュ・コーヒーは、注文が行われたのと同じ支払チャネルを通じて行われた支払いを返金します。返金期間は、各決済手段のものに応じて、通常3~5営業日かかります。クレジットカードでお支払いいただいた場合、カード会社によっては処理に30日ほどかかる場合があります。フラッシュコーヒーは、オフラインでのお支払いのキャンセルおよび返金処理を監視しておりません。

適用される法律で認められる最大限の範囲において、当社は、当社の本アプリおよびその使用に関連する、実際のもの、偶発的なもの、特別なもの、間接的なもの、例示的なもの、懲罰的なもの、結果的なものを問わず、いかなる傷害、損失、請求、損害に対する表明、保証、条件、および責任も排除します(満足のいく品質、目的に対する適合性、および/または合理的な注意と技術の使用に関して法律で暗示される保証を含みますが、これに限定されません)。本免責事項のいかなる部分も

  • 過失に起因する死亡または身体傷害に対する当社またはお客様の責任を制限または排除します。
  • 詐欺、不正な不実表示、または基本的事項に関する不実表示に対する当社またはお客様の責任を制限または排除すること。
  • 適用法で認められていない方法で、当社またはお客様の責任を制限すること、または
  • 適用される法律の下で除外することができない当社またはお客様の負債を除外します。

本アプリおよび本アプリ上の情報やサービスが無償で提供されている範囲において、当社はいかなる性質の損失や損害に対しても責任を負いません。

当社は、必要に応じてご利用条件を更新することがあります。そのため、お客様はこのページを定期的にご覧になり、変更点をご確認ください。変更があった場合には、このページに新しいご利用条件を掲載してお知らせします。 ただし、本規約の内容の変更がお客様にとって不利益なものである場合には、そのような不利益な変更の発効日の少なくとも30日前にお客様に通知します。ただし、お客様に利益をもたらす変更や、法的な理由による変更は、直ちに発効する場合があります。上記にかかわらず、適用される法律上、同意が必要な本規約の修正または変更については、当社が指定する方法でお客様の同意を得るものとします。この場合、変更後の本規約は、当社所定の方法で同意されたお客様にのみ適用されます。

本規約のいずれかの条項またはその一部が、日本の消費者契約法またはその他の法令により無効または執行不能とされた場合でも、本規約の残りの条項または無効または執行不能とされた条項の一部は、完全に効力を有するものとします。

本規約は日本国法に準拠するものとし、お客様は、本アプリの利用または本規約に関連して生じたいかなる訴訟についても、東京簡易裁判所または東京地方裁判所を専属管轄裁判所とすることに同意するものとします。
